Acceptable Use Policy

Purpose

This Acceptable Use Policy (AUP) sets out the rules and guidelines for using Lucrii’s services. By accessing or using Lucrii, you agree to comply with this AUP. This policy protects Lucrii, our users, and the broader community by establishing clear expectations for responsible use.

This AUP should be read alongside our Terms of Service and Privacy Policy.

1. Scope

This AUP applies to:

  • All users of Lucrii (whether on free trials, paid subscriptions, or invited team members)
  • All use of Lucrii’s services, including the web application (available at https://lucrii.io/, https://lucrii.ai/, and https://app.lucrii.io/), integrations, API, and Hermes AI features
  • All content uploaded, created, transmitted, or stored through Lucrii

2. Acceptable Use

Lucrii is a business management platform designed to help you:

  • Manage customer relationships and communications
  • Process orders, quotes, and invoices
  • Integrate with third-party business tools
  • Leverage AI-powered insights through Hermes (if enabled)

You may use Lucrii for any lawful business purpose that aligns with these core functions.

3. Prohibited Uses

You must not use Lucrii to engage in, facilitate, or promote any of the following activities:

3.1 Illegal or Harmful Activities

  • Any activity that violates Australian law or the laws of your jurisdiction
  • Fraud, theft, money laundering, or other financial crimes
  • Distribution of child sexual abuse material or exploitation content
  • Terrorism, violence, or threats of violence
  • Harassment, stalking, bullying, or intimidation
  • Discrimination or hate speech based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics

3.2 Spam and Unsolicited Communications

  • Sending spam, unsolicited commercial emails, or bulk messages without recipient consent
  • Using Lucrii to harvest email addresses or other personal information from third parties
  • Operating email lists that violate the Spam Act 2003 (Cth) or equivalent anti-spam laws
  • Sending communications that mislead recipients about the sender’s identity or the message’s origin

3.3 Malicious or Disruptive Activities

  • Uploading, transmitting, or distributing malware, viruses, trojans, ransomware, or other malicious code
  • Attempting to gain unauthorised access to Lucrii’s systems, other users’ accounts, or third-party systems
  • Reverse engineering, decompiling, or attempting to extract source code from Lucrii
  • Conducting security testing, penetration testing, or vulnerability scanning without prior written authorisation from Lucrii
  • Using automated tools (bots, scrapers, crawlers) to access Lucrii without authorisation
  • Overloading or degrading Lucrii’s infrastructure (e.g., denial-of-service attacks)

3.4 Intellectual Property Violations

  • Uploading or distributing content that infringes copyright, trademarks, patents, trade secrets, or other intellectual property rights
  • Sharing pirated software, cracked licenses, or counterfeit goods
  • Impersonating another person, business, or brand

3.5 Misuse of Lucrii Services

  • Creating multiple accounts to circumvent service limits or restrictions
  • Reselling, sublicensing, or redistributing Lucrii access without authorisation
  • Using Lucrii to compete with Lucrii (e.g., building a competing CRM platform using our infrastructure)
  • Sharing account credentials with unauthorised users or allowing account sharing in violation of your subscription terms
  • Using Lucrii to store or backup data unrelated to legitimate business management purposes

3.6 Privacy Violations

  • Collecting, storing, or processing personal information in violation of the Privacy Act 1988 (Cth) or other applicable privacy laws
  • Using Lucrii to process personal data without appropriate consent or lawful basis
  • Sharing or disclosing other users’ personal information without authorisation
  • Using integrated third-party platforms (e.g., email, CRM, Xero, Shopify, Klaviyo) in ways that violate their terms of service or privacy policies

3.7 Content Restrictions

  • Uploading or transmitting content that is defamatory, obscene, or pornographic (outside of legitimate business contexts)
  • Storing or distributing content that promotes self-harm, eating disorders, or dangerous activities
  • Using Lucrii to facilitate gambling, drugs, weapons, or other regulated goods/services without proper licensing

4. User Responsibilities

As a Lucrii user, you are responsible for:

4.1 Account Security

  • Maintaining the confidentiality of your login credentials
  • Enabling Two-Factor Authentication (2FA) where available
  • Not sharing your account with unauthorised users
  • Immediately notifying Lucrii at support@lucrii.io if you suspect unauthorised access to your account

4.2 Data Accuracy and Compliance

  • Ensuring all data you upload or process through Lucrii is accurate and lawful
  • Complying with all applicable laws when using Lucrii (including privacy, employment, consumer protection, and anti-discrimination laws)
  • Obtaining necessary consents before uploading personal information about third parties (e.g., customer data, employee data)

4.3 Integrated Third-Party Services

  • Complying with the terms of service and acceptable use policies of any third-party platforms you connect to Lucrii (e.g., Shopify, Klaviyo, Xero, Gmail)
  • Ensuring you have authorisation to connect third-party accounts to Lucrii
  • Understanding that Lucrii is not responsible for how third-party platforms use data shared through integrations

4.4 Fair Use of Resources

  • Using Lucrii in a manner consistent with normal business operations
  • Not engaging in excessive or abusive usage that degrades service performance for other users
  • Cooperating with Lucrii if we contact you regarding unusual account activity or resource consumption

4.5 Backups

  • Maintaining your own backups of critical business data
  • Understanding that while Lucrii implements robust data protection measures, you are ultimately responsible for ensuring business continuity

5. Content Monitoring and Moderation

5.1 Our Approach

Lucrii respects your privacy and does not routinely monitor the content you upload or process through the platform. However, we reserve the right to:

  • Investigate potential violations of this AUP if we receive complaints or detect suspicious activity
  • Access account data when necessary to provide customer support
  • Review content to comply with legal obligations (e.g., responding to valid law enforcement requests)

5.2 Automated Systems

We may use automated systems to detect:

  • Malware, viruses, or malicious code
  • Spam or bulk sending patterns that violate the Spam Act 2003 (Cth)
  • Unusual account activity that may indicate unauthorised access or abuse

These systems are designed to protect all Lucrii users and maintain service quality.

6. Enforcement

6.1 Violation Response

If we determine that you have violated this AUP, we may take any or all of the following actions:

  • Warning: Issue a written warning and request immediate corrective action
  • Temporary Suspension: Suspend access to your account while we investigate or until the violation is resolved
  • Service Limitation: Restrict specific features (e.g., email sending, integrations, API access) while allowing continued use of other features
  • Account Termination: Permanently terminate your account and delete your data (subject to legal retention requirements)
  • Legal Action: Report illegal activity to law enforcement or pursue legal remedies for damages caused by your violation

6.2 Factors We Consider

When determining the appropriate response to an AUP violation, we consider:

  • The severity and nature of the violation
  • Whether the violation was intentional or accidental
  • The impact on other users, Lucrii systems, or third parties
  • Your history of compliance with this AUP
  • Whether you cooperated with our investigation and took corrective action

6.3 No Refunds for Violations

If we terminate your account for AUP violations, you will not be entitled to a refund for any remaining subscription period.

6.4 Appeals

If you believe your account was suspended or terminated in error, you may appeal by contacting support@lucrii.io with:

  • Your account email address
  • A detailed explanation of why you believe the decision was incorrect
  • Any supporting evidence

We will review appeals within 7 business days and respond with a final decision.

7. Reporting Violations

If you become aware of any conduct that violates this AUP, please report it to us immediately at support@lucrii.io.

Reports should include:

  • Description of the violation
  • Supporting evidence (screenshots, links, email headers, etc.)
  • Your contact information (if you wish to receive updates on the investigation)

We take all reports seriously and will investigate promptly. While we may not be able to share specific details about our enforcement actions due to privacy considerations, we will acknowledge receipt of your report.

8. Relationship to Terms of Service

This AUP is incorporated into and forms part of our Terms of Service (available at https://lucrii.io/legal/terms-of-service or https://lucrii.io/legal/terms-of-service). Any violation of this AUP is also a violation of our Terms of Service.

In the event of any conflict between this AUP and the Terms of Service, the Terms of Service will prevail.

9. Changes to This Policy

We may update this AUP from time to time to reflect:

  • Changes in applicable laws or regulations
  • New features or services offered by Lucrii
  • Evolving security threats or abuse patterns
  • Feedback from users and stakeholders

When we make material changes to this AUP, we will:

  • Notify you via email to the address associated with your account at least 30 days before the changes take effect
  • Display a notice on the Lucrii platform
  • Update the “Last Updated” date at the top of this policy

Your continued use of Lucrii after the effective date of any changes constitutes your acceptance of the revised AUP.
